RELEASE AND WAIVER

For consideration of Court Side, a company located in The Netherlands, (hereinafter referred to as “the Camp organizers”) inviting and permitting the under-signed to participate in the Euro Challenge in Las Vegas, Nevada and does hereby now and forever, fully and finally for himself, his heirs, administrators, executors, successors, and assigns, agree to waive all claims of whatever nature, and forever release, remise, acquit, discharge, and hold harmless Court Side, as well as the Bill & Lillie Heinrich YMCA at 4141 Meadows Lane, Las Vegas, NV 89107, the athletic facility of the Euro Challenge, the Board of Regents Nevada System of Higher Education and any other facility used for this camp, its respective officers, agents, employees, successors, assigns, and assurers and all other persons, firms, corporations, associations or partnerships associated therewith from all claims, demands, actions or cause of actions arising out of any losses or injuries to his person or property, or both, which may result, be sustained, or be received by him as a result of his attending and participating in the above Euro Challenge.

The player understands that by signing this release and waiver, he covenants and agrees that he, as well as his heirs, administrators, executives, successors, and assigns, will never institute any suit or action at the law or otherwise against Court Side, the Bill & Lillie Heinrich YMCA, the athletic facility of the Euro Challenge, and any other facility used for this camp, or in any way aid in the institution or prosecution of any claim, demand, action or cause of action for damages, costs, loss of services, expenses, or compensation for or on account of any damage, loss or injury either to his person, property, or both, which may result from the undersigns attendance and participation at the aforementioned Euro Challenge or any travel or other activity associated therewith.

The player acknowledges that Court Side has the right to profit financially in any legal manner from the group image of the players as they are attending the Euro Challenge and wear the Camp uniform.  If requested, such team image can be associated with brands or products of any kind and the athlete has no right to any compensation for such association.  Furthermore, Court Side cannot request the Player to perform any individual promotional activities not in connection with the Euro Challenge group and its uniforms, unless otherwise stipulated.

The player acknowledges that the camp fee is a non-refundable.

The player also acknowledges that the camp offers no guarantee that the player will be offered a contract by a professional club or agent/agency. Finding a club or an agent depends on many things. For example, the performance at the camp but above all a complete basketball resume with above average statistics from a reputable high-level league.

The player further acknowledges that by attending the above mentioned Euro Challenge he voluntarily assumes all risks and dangers known and unknown, foreseen or unforeseen, attendant to his attendance and participation in said Euro Challenge. The undersigned further declares and represents that no promise, inducement, or agreement not herein expressed has been made to the undersigned, and that this release expressed has been made to the undersigned, and that this release contains the entire agreement between the parties to this release and that the terms of this release are contractual and not a mere recital. The undersigned has read the preceding release and fully understands it.
