Slovenian player Jurica Golemac (209 cm) won his arbitration case at the FIBA Basketball Arbitral Tribunal versus his former team, VAP Kolossos Rodou from Greece.

In the contract entered into by Golemac and Kolossos in November 2010, the team undertook to pay the player a total base salary of EUR 75,000 net of all Greek taxes and charges. The contract also contained a clause that specified certain bonuses that were contingent on the team’s performance in the Greek league.

“BONUSES (net and cumulative)

(i) If the Club reaches play off shall earn amount of 5.000 Euro Net (iii) [sic]

For each playoff round what the Club advances at Player shall earn

amount of 2.000 Euro, net / per round”

jurica golemacKolossos made partial payments under the contract and the dispute and request for arbitration revolved around the balance of EUR 40,000 which the team allegedly failed to pay Golemac.

Golemac requested the payment of all salaries and bonuses and interest at the “applicable Swiss statutory rate” on all outstanding amounts.

Despite several invitations by the BAT, the Club did not make any submissions within the time limits set by the Arbitrator, Ms. Annett Rombach, in accordance with the BAT Rules.
