Dwight Hardy wins arbitration vs. Avellino

Former St. John’s player Dwight Hardy Jr. (188 cm, St. John’s’11) filed for arbitration at the Basketball Arbitral Tribunal (BAT) versus his former team, Sidigas Avellino.  Dwight played six games for Sidigas Avellino in the 2012-13 season.

He sought payment for back salaries owed to him by the team as stipulated in his player contract engaged in by him and the Italian club. Dwight had a problem obtaining a working visa, relating to his newly issued Congolese passport.

It was the team’s contention that they did not owe him said salaries during the period he was not with the team due to his visa problems.

After deliberation by the assigned arbiter of the case, Hardy was awarded with a favorable decision, citing that his player contract was already in full force and effect during the period in question and the team owed him salaries being claimed. The official award by BAT are as follows:

1. SS Felice Scandone Avellino spa is ordered to pay to Mr. Dwight Hardy Jr. USD 156,000.00 net together with interest of 5% p.a. on this amount

– from 11 September 2012 on the amount of USD 9,000.00,

– from 11 October 2012 on the amount of USD 23,000.00,

– from 11 November 2012 on the amount of USD 23,000.00,

– from 11 December 2012 on the amount of USD 23,000.00,

– from 11 January 2013 on the amount of USD 23,000.00,

– from 22 January 2013 on the amount of USD 55,000.00.

2. SS Felice Scandone Avellino spa is ordered to pay to Mr. Dwight Hardy Jr. EUR 1,800.00 as a reimbursement of the arbitration costs advanced by him.

3. SS Felice Scandone Avellino spa is ordered to pay to Mr. Dwight Hardy Jr. EUR 2,432.50 as a contribution towards his legal fees and expenses.

4. Any other or further-reaching requests for relief are dismissed
