Klemen Prepelic

Slovenian guard Klemen Prepelic filed a claim against his former team Banvit  Basketbol Kulubu (Turkey-TBL) at the Basketball Arbitral Tribunal (BAT) for outstanding salaries, buyout payment, benefits, penalties and interest. He submitted that the team did not allow him to rejoin the club for the second season of his three-year contract. The club, in its answer, claimed that it acted ethically as it sought a settlement with the player after the new coach determined that he did not want the player. He signed with the team during the 2013/14 season.

The arbitrator of the case upheld the claim in its entirety.

Award

1. BC Banvit Bandirma shall pay Mr. Klemen Prepelic, as contractual damages, USD 269,502.50, net of tax, plus interest at 5% per annum on such amount from 6 October 2014 onwards.

2. BC Banvit Bandirma shall pay Mr. Klemen Prepelic an amount of EUR 5,252.00 as reimbursement of his arbitration costs.
3. BC Banvit Bandirma shall pay Mr. Klemen Prepelic an amount of EUR 10,000 as a contribution to his legal fees and expenses.
4. Any other or further-reaching requests for relief are dismissed.
