Henry Domercant and his agency filed a claim against his former club Galatasaray Liv Hospital Istanbul (Turkey-TBL) at the Basketball Arbitral Tribunal (BAT) for outstanding salaries, bonuses, reimbursement of fines,  rental fee benefits, agent fees, and interest. They submitted that the Club made only partial payment under the contract and that it improperly fined all of the club’s players due to their performance.  In its Answer, the Club only contested the Player’s claims for a reimbursement of the fines and some of the bonus requests arguing that the fine and its reasons were provided to and uncontested by the Player and that some of the bonuses requested were not promised. Domercant is an American player who also holds a passport from Bosnia and Herzegovina. He was on the roster of Galatasaray from 2012 to 2014.

The Arbitrator of the case partially upheld the claim. BAT Award reads as follows:

1. Galatasaray Spor Kulübü Dernegi shall pay Mr. Henry Domercant, as compensation, the following amounts, net of tax:

• USD 115,000.00 plus interest at 5% per annum on such amount from 1 June 2014 onwards.

• USD 165,000.00 plus interest at 5% per annum on such amount from 16 June 2014 onwards.

• USD 17,500.00 plus interest at 5% per annum on such amount from 16 June 2014 onwards.

• USD 40,000.00 plus interest at 5% per annum on such amount from 16 June 2014 onwards.

2. Galatasaray Spor Kulübü Dernegi shall pay The Neustadt Group as compensation, USD 50,000.00 net of tax, plus interest at 5% per annum on such amount from 16 November 2013 onwards.

3. Galatasaray Spor Kulübü Dernegi shall pay Mr. Henry Domercant and The Neustadt Group an amount of EUR 6,202.50 as reimbursement of their arbitration costs.

4. Galatasaray Spor Kulübü Dernegi shall pay Mr. Henry Domercant and

The Neustadt Group an amount of EUR 3,000.00 as a contribution to their legal fees and expenses.

5. Any other or further-reaching requests for relief are dismissed.
